This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for extension of interim bail order.

Learned counsel for the petitioner on the other day submitted that the petitioner was granted interim bail on 27.09.2022 and during the interim bail period, he met with an accident, sustained fracture injuries and admitted in the hospital.

Some medical documents have been annexed to the interim application.

Learned counsel for the State was asked to obtain instruction on the interim application.

// 2 // Today, learned counsel for the State has produced the written instruction received from the Inspector in-charge of Sonepur police station dated 13.02.2023 from which it appears that the petitioner was admitted at the hospital and treated by Dr. Virender Singh as outdoor patient and there is nothing to show that the petitioner is now under treatment as an indoor patient or he is unable to move.

Therefore, I am not inclined to extend the interim bail order. The petitioner shall surrender before the learned trial Court on or before 27.02.2023 failing which the learned trial Court shall take coercive steps in accordance with law for the arrest of the petitioner. If the petitioner surrenders at right time and there is necessity of his further treatment in any Government Hospital, the same shall be provided to him by the jail authorities.

Accordingly, the I.A. is disposed of.

A copy of the order be communicated to the learned trial Court for compliance.

A free copy of this order be handed over to the learned counsel for the State.
