This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.1021 of 2022 pending on the file of learned S.D.J.M., Keonjhar, arising out of Keonjhar Town P.S. Case No.212 of 2022, for commission of offence under Section 379 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. District Judge-cum-Special Judge, (Vig.), Keonjhar by order dated 22.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Perused the order of rejection.

It is submitted by the learned counsel for the Petitioner that though the Petitioner is innocent but he has been roped in the case at hand due to criminal proclivity and remanded.

Taking into account the nature of allegation, filing of charge sheet on 27.08.2022 and the Petitioner is in custody since 29.07.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the Petitioner shall appear before the jurisdictional police station once every week till conclusion of trial.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per rule. (V. NARASINGH) Judge PKS
