Heard learned counsel appearing for the petitioner. Order No.

Undisputedly, petitioner has a pending appeal involving the demand involved herein and that too after disposal of the Original Proceeding under the OPP Act, 1972. For the opinion of this Court, petitioner has clear remedy to get stay in the event the apple already involved such demand. In the circumstance, this Court finds there is nothing required to be adjudicated in the present writ petition except leaving it to the petitioner in the event of pendency of his appeal, may apply for stay. In the event petitioner approached the appellate authority involving OPP Appeal No.8 of 2019 for interim protection for the purpose of same demand, the appellate authority shall do well in taking up the appeal at least within a period of one week and pass order on the same.

The writ petition stands disposed of with the observation made hereinabove.
