Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking to quash the orders dated 28.05.2016 so far as promoting opposite parties no.4 and 5 to the rank of Senior Clerk is concerned and to issue direction to the opposite parties to promote him to the post of Senior Clerk from the date of promotion of his juniors with all consequential benefits.

Learned counsel for the petitioner contended that this matter is covered by the judgment of the apex Court in the case of V. Kashyap v. Indian Airlines, AIR 1994 SC 2128. Therefore, direction may be given to the authority to consider the case of the petitioner in the light of the aforesaid judgment. 5.

Considering the contention raised by learned counsel for the petitioner and after going through the records, this writ petition stands disposed of directing the opposite parties-authorities to consider the case of the petitioner taking into consideration the judgment of the apex Court V. Kashyap v. Indian Airlines, AIR 1994 SC 2128 and pass appropriate order in accordance with law within a period of three months from the date of production of

certified copy of this order.

Issue urgent certified copy as per rules.
