Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.72 of 2021, pending in the Court of the learned Adhoc Additional District & Sessions Judge FTSC (POCSO), Jagatsinghpur, arising out of Balikuda P.S. Case No.455 of 2021, for commission of alleged offences under Sections 366/376(2)(n)/342/507 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Adhoc Additional District & Sessions Judge FTSC (POCSO), Jagatsinghpur, by order dated 17.10.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioner is in custody since 22.12.2021 and as charge sheet has already been filed on 13.02.2022, further continuance of the petitioner in custody is not warranted.

Photo stat copy of the depositions submitted by the learned counsel for the petitioner is taken on record. 6.

Perused the deposition of informant examined as P.W.3. 7.

Considering the same, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.
