Learned counsel for the Petitioner wants to withdraw the Writ Petition with liberty to raise the issue involved herein in a civil proceeding.

The Writ Petition stands dismissed as withdrawn but however with liberty as prayed for.

This Court observes in the event any civil proceeding is initiated, the same shall be decided in accordance with law and without being influenced by the observation made by the Commissioner in disposal of the proceeding under Section 15(b) of the O.S.S. Act.
