01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Ms. A.K. Dei, learned counsel for the Petitioner and Mr. YSP Babu, learned A.G.A appearing for the state Opp. Parties.
3. The Petitioner challenges the order of dismissal passed on 23.08.2016 under Annexure-1 because of his conviction and sentence passed in Vigilance Trial No. 638 of 2017 arising out of VGR case No. 129 of 1993 by the learned Special Judge -CumVigilance, Balasore vide Judgment dtd. 26.08.2014.
4. It is submitted against the said order of conviction and sentence, the petitioner preferred an appeal before this court and the said appeal is subjudiced on 04.04.2014. Since the order of dismissal has been passed because of the conviction and sentence passed by the petitioner in the aforesaid vigilance case this court finds no illegality in the said order. However, it is observed that the said
// 2 // order shall be subject to the final outcome of criminal appeal No. 442 of 2014.
5. The writ petition is disposed of with the aforesaid observation and directions.
