Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.733 of 2022, pending in the Court of the learned JMFC, Barbil, arising out of Barbil P.S. Case No.217 of 2022, for commission of alleged offences under Sections 395/397 of IPC read with section 25/27 of the Arms Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Champua, Camp at Barbil, by order dated 20.10.2022 in the aforementioned case, the present BLAPL has been filed. 4.
Since the matter was under investigation at the time of consideration by the learned Court in seisin and the petitioner has a criminal antecedent of being accused of an offence under Section 302 of IPC, this Court is not inclined to entertain this bail application at this stage.

Accordingly, the BLAPL stands disposed of.

Liberty is granted to the petitioner to move the learned Court in seisin post charge sheet which shall be considered on its own merit without being influenced by the earlier rejection or the order passed by this Court.
