Heard learned counsel for the Parties.

This matter involves a challenge to the order passed by the Appellate Authority under Annexure-9.

Considering the rival contentions of the Parties and on perusal of the appellate order at Annexure-9, this Court finds, the appellate order is absolutely unreasoned one. Law is fairly well settled holding in the event of disposal of Appeal, there should be reason assigned in dismissing such Appeal or allowing the Appeal, in absence of which such order is not sustainable. 4.

In the process, this Court interferes with the impugned order at Annexure-9 and sets aside the same but however since there is requirement of fresh disposal of the Appeal by the Divisional Forest Officer, Phulbani Forest Division, O.P.3, the matter is remitted to

// 2 // O.P.3 for re-hearing of the Appeal involving the Petitioner. The Petitioner is directed to produce a copy of this order before O.P.3 and take a date of personal hearing involving the Appeal. The Appeal involved herein shall be disposed of within a period of two months from the date of communication of this order by the Petitioner.
