IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.C(OAC )No. 3479 of 2016 Bijaya Kumar Das ....

Petitioner -versusState of Odisha & Others ....

Opposite Parties COROM:

JUSTICE BIRAJA PRASANNA SATAPATHY

ORDER

23.08.2022

1. 1.

This matter is taken up through Hybrid Mode.

Order No

2. Heard Mr. S. Behera, learned counsel for the petitioner and Mr.M. Balabantaray, learned Standing counsel.

3.

The petitioner has filed the present Writ petition with the following prayer.

"To quash the merit list in respect of the applicant in prusance to notice dated 23.8.2016 under Annexure-6 series.

And further be pleased to direct the Respondent No.2 to consider the case of the applicant for the post of Sikhsya Sahayak by considering his objection dated 3.9.2016 under Annexure-8 within a stipulated period."

4.

This Court after going through the materials available on record finds that in the advertisement issued on 11.1.2016 in order to be eligible to make the application, a candidate must be in between the age of 18 years and 35 years as on 11.1.2016. As per the said advertisement, the petitioner's date of birth being

// 2 // 7.6.1975, he is not eligible to make the application as he is over-aged and his application was rightly not entertained by the opp. parties. Mr. Behera, learned counsel for the petitioner brought to the notice of this Court a corrigendum issued under Annexure-9 series. But this Court finds that the said corrigendum was issued in respect of the advertisement issued on 27.10.2014 and not in respect of an advertisement issued on 11.1.2016, basing on which the petitioner has made the application. Since admittedly, the petitioner is not within the age limit as provided in the advertisement, the claim made by the petitioner in the writ petition cannot be entertained.

5.

The Writ Petition is accordingly dismissed.
