1. The petitioner is stated to be a defaulting borrower of a cash credit facilities availed for a sum of Rs.45,00,000/- on 7th September,2018 from the Indian Bank, Kamapalli Branch, Berhampur, Dist-Ganjam. Due to non-servicing of the account and default in payment, it was classified as NPA on 12.02.2022 and thereafter recovery process under the SARFAESI Act,2002 was initiated culminating into two failed auction efforts of the mortgaged property.

The only prayer being made before the Court is that the petitioner is willing to pay the outstanding liabilities of around Rs.1,60,00,000/- as on today.

2. After hearing counsel for the petitioner, we fail to understand as to why does the petitioner need the intervention of this Court for such a prayer. If the

// 2 // petitioner wants to pay he is welcome to approach the Bank and settle the accounts.
