The matter is taken up through hybrid mode.

Heard Mr. B.B. Singh, learned counsel for the Appellant and Mr. N.K. Sahoo, learned counsel for Respondent Nos.1 and 2. 3.

It is submitted by both parties that the matter has been settled between the parties outside the court and in this regard an affidavit has been sworn by the claimants - Respondents on 12th July, 2022. The copy of the said affidavit is also produced.

Mr. Sahoo, learned counsel for the claimants admits such settlement between the parties and receipt of agreed amount by the claimants.

Thus, as prayed by Mr. Singh, the appeal is disposed of as withdrawn.

The statutory deposit made by the appellant before this court along with accrued interest be refunded to the Appellant - insurer on proper application.
