1. Heard learned counsel for the Petitioner and the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences U/s. 419/420/468/471/407/120-B, I.P.C.

3. Learned counsel for the Petitioner submits that the F.I.R. prima facie reveals that some of the officials of the Company along with the Driver had colluded for selling out the loaded materials of the vehicles in question that had reached the destination at Jajpur. The materials loaded in the truck were the purchased materials and consigned to the destination. He further submits that the present Petitioner is the owner of the said vehicles and he has no role in the alleged occurrence.

4. Keeping in view the submission of the parties and having gone through the nature of allegations as emerged from the materials on

// 2 // record, and further the circumstances appearing, the seriousness and gravity of the offences, it is directed that in the event the Petitioner surrenders and moves for bail before the learned J.M.F.C., Jajpur Road in C.T. Case No.1383 of 2022 arising out of Jakhapura P.S. Case No.118 of 2022 within a period of three weeks hence, he shall be allowed to go on bail on such terms and conditions as would be deemed just and proper by the said court, but subject to the further conditions that the Petitioner shall appear before the I.O. once in every week and shall also cooperate with the investigation as and when required. He shall also appear in the trial court on each date of trial, without fail, till conclusion of the trial.

5. The ABLAPL is disposed of accordingly.
