01. 1. This matter is taken up through Hybrid Mode. Order No

2. Heard learned counsel for the Petitioner and learned counsel for the State.

3. This writ Petition has been filed with the following prayer:

"(i) The Hon'ble Tribunal be pleased to direct the respondents to produce the DPC file on the next date of hearing for kind perusal of the Hon'ble Tribunal and the Hon'ble Tribunal be further pleased to direct that pendency of this case shall not stand as a bar for the respondents to consider the claim of the applicant as prayed for in the present original application; and (ii) The Hon'ble Tribunal be pleased to pass such other interim order/orders as is deemed fit & proper under the facts & circumstances of the case."

4. The counter affidavit has been filed by the Opp. Parties with the stand that in the meantime, the Petitioner has been given promotion to the post of Assistant Fishery Officer.

5. It is submitted by Mr. Mohanty, learned counsel for the Petitioner that the Petitioner while being extended with the said benefit of promotion has not been given the said promotion from the date he is otherwise entitled to.

6. Considering such submission of Mr. Mohanty, learned counsel for the Petitioner, this writ Petition is disposed of by giving liberty to the Petitioner to file appropriate application before the competent authority in respect of his prayer that he is otherwise entitled for promotion from a previous date. It is observed that if any such representation is filed within 3 (three) weeks hence, the same shall be considered in accordance with law within a period of three months thereafter.

The order so passed be also communicated to the Petitioner.

7. With the aforesaid liberty the writ Petitioner has disposed of.
