The petitioner, while working as Mali in the Office of the Divisional Forest Officer, Cuttack Forest Division, Ghatakula under Madhupatna Police Station in the district of Cuttack, being aggrieved by non-consideration of his case for promotion to the post of Forest Guard, even after putting in 25 years of service, has approached the learned Odisha Administrative Tribunal by way of filing Original Application. The petitioner has challenged the decision of the Government of Odisha in Forest and Environment Department vide Letter No.FE/FE3-FE-0315-2015-5342/&E, dated 19th March, 2016, whereby the proposal for relaxation of Rule-15(C) of the Odisha Sub-ordinate Forest Service (Method of Recruitment and conditions of Service of Forest Guards) Rules, 1998 for promotion of the petitioner was turned down.

Mr. Prem Kumar Pattnaik, learned Addl. Government Advocate appearing for the Opposite parties-State submitted that at the time of filing of the Original Application, the petitioner has disclosed his age to be at about 54 years and by

// 2 // efflux of time he would have been retired on superannuation and, therefore, the writ petition has been rendered infructuous. 3.

In view of such submission, the writ petition is dismissed as infructuous.
