This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with T.R. Case No.53 of 2022, pending in the Court of the learned Additional Sessions Judge-cum-Special Judge, Koraput, arising out of Semiliguda P.S. Case No.0075 dt.10.05.2022, for alleged commission of offences under Sections 20(b)(ii)(C)/29 of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Koraput, by order dated 17.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted at the bar that the charge-sheet was filed on 09.11.2022 and since it comes to the fore that the learned Special Judge, considered the matter on 17.08.2022, this Court is not inclined to consider the bail application of the petitioner at this stage.

Giving liberty to the petitioner to move the learned Court in seisin over the matter afresh raising all grounds including conscious exclusive possession is not attributable to the petitioner and the same shall be considered on its own merits without being influenced by the earlier order or order passed by this Court. 7.
Accordingly, the BLAPL stands disposed of.
