1. This matter is taken up through hybrid mode.

2. The original application, which was filed before the Odisha Administrative Tribunal, Bhubaneswar, has later been transferred to this Court after abolition of the OAT.

3. The petitioner applied for the post of Junior Clerk pursuant to the Advertisement No.2370/dated 01.06.1999 and selected for the said post and she was placed in the waiting list at Sl. No.12. In the said recruitment test, only 22 nos. of candidates were appointed on 07.12.1999. Though in the advertisement, there were 65 nos. of post available for fill up but only 22 nos. of candidates were appointed and 14 candidates were kept on waiting list. The petitioner was appointed as Junior Clerk vide order No.1416 dated 20.07.2009 issued by the Collector, Balangir.

4. The main grievance of the petitioner before the Tribunal is that she may be brought over to the O.C.S. Pension Rules, 1992 instead

// 2 // of New Pension Scheme as it is done in the cases of 22 persons, who were appointed in the same selection recruitment process.

5. Since the matter was of the year, 1999, the cause of action might have lost its significance. The learned counsel for the petitioner submits that he has no instructions in the meantime.

6. In view of the above, the WPC (OA) is disposed of for want of instructions.

7. The petitioner is free to approach this Court if any cause of action survives.
