Heard learned counsel for the Parties.

Petitioner not disputing that the conversion of land involved herein involves a parcel of a Chaka land. It appears a proceeding under Section 8(A) at the instance of Petitioner involving such land is rejected on the premises in the event such request is accepted, it will be affected the Chaka as a whole.

Learned State Counsel on production of instruction memo submits that the land involved is a parcel of the compact holding carved under the O.C.H. & P.F.L. Act. Further there is also requirement of consent of development authority in such deviation. In the circumstance and for the clear reason in the impugned order, this Court is not inclined to entertain the Writ Petition which is dismissed accordingly.
