1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. This application for anticipatory bail U/s.438 Cr.P.C. has been filed by the Petitioners in apprehension of arrest for their alleged involvement in the offences U/s. 341/323/387/506/294/34, I.P.C. in connection with Dhanupalli P.S. Case No.385 of corresponding to G.R. Case No.3936 of 2022 pending in the Court of learned S.D.J.M., Sambalpur.

3. Keeping in view the submission of the parties, the nature of allegations as emerged from the materials on record, the circumstances appearing, the seriousness and gravity of the offences, it is directed that in the event the Petitioners surrender and move for bail before the learned S.D.J.M., Sambalpur in the aforesaid G.R. Case, within a period of three weeks from today,

// 2 // they shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court, but subject to verification of Injury Report and other Criminal Antecedents of the Petitioners. If the injuries are found to be grievous in nature and/or the Petitioners have any other criminal antecedents of similar nature besides the present case, the bail order shall not be given effect to and the concerned court shall be free to deal with the bail application in accordance with law.

However, in case it is proposed to allow, the same may be subject to further conditions that the Petitioners shall appear in person before the learned court below on each date of posting of the case and shall appear before the I.O. / I.I.C. of the concerned P.S. once in a week on such date and time fixed by the I.O. / I.I.C. for a period of six months or till submission of Final Form as the case may be.
