1. 1. This matter is taken up through hybrid mode.

2. The writ petition has been registered before this Court on 17.12.2021, after the Original Application was transferred from the learned Orissa Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.

3. On perusal of the available order-sheets of the leaned Tribunal, it is indicated that notices were issued by the learned Tribunal on 22.07.2015 and the following interim order was passed :

" xx xx So far as prayer for interim relief is concerned, any appointment to the post of Pharamacists pursuant to Annexure-1 is subject to final outcome of the O.A."

4. Learned counsel for the petitioner submits that he has no up-to-date instruction to pursue the matter at present on behalf of the petitioner.

5. Learned Additional Standing Counsel referring to the counter dated 13.09.2016 submits that the writ petition would not survive after passage of seven years of its filing as the advertisement dated 14.09.2015 was for appointment of

// 2 // Pharmacists on contractual basis and the period of contract long since over.

6. Having heard learned counsel for the parties, the writ petition is disposed of for lack of instructions from the petitioner to pursue the matter granting liberty to revive the same within sixty days for any surviving cause of action. ( M.S.Sahoo) Judge Gs
