This matter is taken up through hybrid mode.

None appears for the petitioner when the matter is called. When the matter was last taken up on 19.05.2022, none had appeared for the petitioner. After considering the matter is some detail and considering the submissions of the learned counsel for the State, the following order was passed:- "2. The writ petition has been registered before this Court on 17.12.2021 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack.

3. On perusal of the available order sheets of the learned Tribunal it is indicated that notices were issued on 25.2.2016 and the matter was never taken up/pursued after 25.1.2019.

4. The Original Application was filed by the petitioner challenging the advertisement dated 29.4.2013 inviting applications for appointment as Village Level Worker in different Gram Panchayats of the district of Nuapada. The applicant before the learned Tribunal (petitioner) prayed for quashing of the said advertisement dated 29.4.2013.

5. On perusal of the order sheet of the learned Tribunal, it is indicated that there is no interim order regarding the recruitment that was initiated in the year 2013.

6. Learned Standing Counsel referring to the counter filed by the District Education Officer-O.P. No.2 as

// 2 // well as averments made in the O.A./writ petition, submits that nothing would survive for adjudication at present and also the allegations regarding the irregularity in accordance with reservation, is not correct as the roster maintained by the authority has been strictly followed for filing up of the posts in different categories, i.e., UR, SC, ST & SEBC.

7. Having heard learned Standing Counsel, to grant another opportunity to the petitioner, list on 14.7.2022."

Learned Standing Counsel reiterates the submissions on behalf of the State as noted in the order dated 19.05.2022. 4.

Having heard learned Standing Counsel, the writ petition is dismissed for non-prosecution.
