This matter is taken up through hybrid arrangement (virtual/physical mode).

This is the second journey of this petitioner, who is in custody in connection with Khandagiri P.S. Case No.156 of 2019 corresponding to T.R. Case No.146 of 2019 pending in the Court of the learned Additional Sessions Judge, Fast Track Spl. Court (POCSO), Bhubaneswar for offence punishable under sections 376(AB), I.P.C. read with section 6 of the POCSO Act in filing this application under section 439, Cr.P.C. for his release on bail.

Keeping in view the submission of the learned counsel for the Petitioner and learned counsel for the State, the record being gone through; it is seen that the prayer for grant of bail has been rejected by the Trial Court on 23.10.2021 when the trial had just commenced. In the given situation, taking into account the deposition of the witnesses already examined in the trial, the application stands disposed of granting liberty to the Petitioner to renew his prayer before the Trial Court citing all such developments which have taken place in the meantime for their consideration in proper prospective and disposal in accordance with law. 4.

Issue urgent certified copy as per rules.
