This matter is taken up through virtual/physical mode. 2.

The Original Application No. 1451 of 2015 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 1451of 2015.

The Petitioner, Excise Constable, having failed to join in the place he was transferred, was put under suspension by virtue of order passed by Opposite Party No.3 (Collector, Balasore). In the writ petition, the Petitioner submitted that even though reply to show cause notice has been furnished before the authority, the same has not been considered. Hence, he approached this Court with a prayer to quash the order of suspension and memorandum of charges dated 26th March, 2015.

Heard Mr. P.K. Mohanty, Additional Standing Counsel, who has submitted that by efflux of time the matter has been rendered infructuous and it seems no cause of action survives.

In view of such submission, the writ petition is dismissed as infructuous.
