This matter is taken up through Hybrid Mode.

Order No 2.

Heard Mr.S. Behera, learned counsel for the petitioner and Mr. Satapathy, learned Standing Counsel.

The petitioner is aggrieved by the order dated 19.1.2016 passed by Opp. party No.2 under Annexure-11 wherein the prayer of the petitioner for approval as against the post of 4th Peon in Garhbadaput High School in the district of Puri.

It is submitted by the learned counsel for the petitioner that similar issue has been decided by this Court in its judgment dated 5.7.2022 passed in WPC(OAC) No.2620 of 2016. This Court in the said judgment while quashing the similar order of rejection directed the Opp. Parties to approve the appointment of the petitioners therein as against the 4th post of Peon. It is submitted that the claim involved in the present writ petition is similar to the issue which has been decided by this Court in the aforesaid writ petition.

Considering such submission, this Court while quashing Annexure-11 directs Opp. Party No.2 to take a fresh decision on the claim of the petitioner for his approval in the light of the order passed by this Court in the above noted case.

The petitioner is permitted to approach to Opp. Party No.2 along with a copy of this order and the judgment passed by this Court within a period of seven days from today. Opp. Party No.2 is directed to take a fresh decision within a further period of three months .

With the aforesaid observation and direction, the Writ Petition is disposed of.
