This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "The Respondent No.2 (E.E) may be directed to submit/ transit the representation of the application to Respondent No.1(S.E) which was received by Respondent No.2 (E.E) on 10.12.2009 issued to him by the Asst.

Engineer R.W.S & S Sub-Division Puri vide its Letter No.8483 dt. 09.12.2009 within a stipulated time and a further direction may be passed to the Superintending Engineer R.W.S & S Circle, Bhubaneswar to consider the said representation and appoint the applicant as Electrical or wire man in R.W.S & S Division, Puri as the applicant is discharging the said work since 2008 with permit and "B" Certificate within stipulated time on being received from the Executive Engineer.

Any other appropriate directions may kindly be issued / passed as this learned Tribunal considered and proper".

It is submitted by Mr. Dash, learned counsel for the Petitioner that in the meantime the Petitioner has come under the Control of Panchayatiraj & Drinking Water Department.

In view of such submissions made by Mr. Das, Petitioner is permitted to make a comprehensive representation before the Secretary, Panchayatiraj & Drinking Water Department within a period of four weeks hence. Petitioner is also permitted to implead Secretary, Panchayatiraj and Drinking Water Department as Opposite Party No.3 to the Writ Petition. 6.

It is observed that if such a representation is filed within the aforesaid period, the Secretary, Panchayatiraj & Drinking Water Department, the Opposite Party No.3 shall do well to take a lawful decision on the same within a period of three months from the date of receipt of such representation. The order so passed be also communicated to the Petitioner. 7.

With the aforesaid observations and directions, the Writ Petition is disposed of.
