This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.264 of 2022 pending on the file of learned J.M.F.C., Kantamal, arising out of Kantamal P.S. Case No.134 of 2022, for commission of offence under Sections 379/427 IPC.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned Addl. Sessions Judge, Kantamal by order dated 17.10.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegation and the period of custody since 26.09.2022, this Court the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Additionally, it is directed that the Petitioner shall appear before the jurisdictional Police Station of the learned Court in seisin once every week till submission of final form. The date and time to be fixed by the learned Court in seisin over the matter. Certification of such appearance shall be submitted to the learned Court in seisin over the matter.

The BLAPL is accordingly disposed of.
