ORDER(Oral) 13.7.2022 02 1. This matter is taken up through hybrid mode.

2. When the matter was last taken up on 2.5.2022, after hearing learned counsel for the parties, following order was passed :

"2. The writ petition is registered before this Court on 17.12.2021 after the Original Application was transferred upon abolition of the learned O.A.T., Cuttack Bench, Cuttack.

3. Notices were issued on 20.4.2015 and was never taken up/pursued thereafter till it is listed today after seven years before this Court.

4. The Originial Application was filed in the year 2015 by the petitioner who was aged about 50 years while working as Assistant Teacher, Srinibas Upper Primary Middle English (UPME) School, Ranital, Bhadrak challenging the order dated 12.1.2015 (Annexure-5) issued by the Block Education Officer, Bhadrak (O.P. No.2) directing the petitioner to be put under suspension pursuant to disciplinary proceeding initiated by order dated 26.9.2014 passed by the Block Education Officer, Bhadrak (O.P. No.2).

5. Learned counsel for the petitioner submits that regarding present status of the service of the petitioner, she has no upto-date instruction.

6. Learned Standing Counsel submits that he has received instruction dated 24.2.2016, but due to lapse of time, he shall obtain up-to-date instruction regarding service of the petitioner as on date.

7. As prayed for, list on 13.7.2022."

4. It is submitted by learned counsel for the petitioner that the matter has become infructuous by efflux of time.

6. Accordingly, the writ petition is disposed of as infructuous. (M.S.Sahoo) Judge dutta
