This matter is taken up through Hybrid Mode.
Order No 2.
Heard Mr. S. Behera, learned counsel for the petitioner and Mr. R.N. Mishra, learned A.G.A 3.
The petitioner is aggrieved by the office order dated 23.8.2016 by Opp. party No.2 wherein a direction was issued to withdraw his Grade Pay allowed in his favour vide order under Annexure-4. But the corrigendum issued by the self-same authority on 23.8.2016 shows that the impugned order will be applicable in respect of those contractual employees who were engaged w.e.f 12.8.2014. Since admittedly, the present petitioner is engaged prior to 2014, the impugned order dated 23.8.2016 under Anexure-6 cannot be applied to the case of the petitioner.
// 2 // 4.
In view of the prayer made in the Writ Petition is not justified and the writ petition is disposed of with an observation that in view of the corrigendum issued by the said Opp. Party No.2 on 23.8.2016, no recovery can be effected from the petitioner.
5.
The Writ Petition is accordingly disposed of. (Biraja Prasanna Satapathy) Judge Sangita
