1. Heard learned counsel for the Petitioner and the State.

2. By means of this application under Section 438, Cr.P.C. the Petitioner seeks interim protection, while no F.I.R. seems to have been lodged against him. Whereas, learned counsel for the Petitioner submits that notice under Section 179(2) of the Railway (Second Amendment) Act, 1989 has been issued against the Petitioner, calling upon him to give evidence.

3. In such eventuality, this Court is not inclined to admit the application under Section 438, Cr.P.C. at this stage. However, liberty is granted to the Petitioner that in case any cause of action arises subsequent to the notice issued, fresh bail application may be moved by the Petitioner.

4. The ABLAPL is disposed of accordingly.
