1. Heard learned counsel for the Petitioner and the State.

2. This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail allegedly for his involvement in the offences under Sections 365/342/324/307/34, I.P.C.

3. Having regard to the fact that the co-accused persons have since been acquitted in the trial faced by them in connection with the present case, i.e. Boden P.S. Case No.125 of 2014 corresponding to C.T. Case No.528(A) of 2014 pending in the Court of learned J.M.F.C., Khariar, the Petitioner is directed to appear before the court in seisin over the matter within three weeks hence and move for bail, the learned Magistrate concerned shall take up the bail application of the Petitioner in the first hour of the day itself, and in case of its rejection, the Petitioner is at liberty to move to the higher forum for bail, and in such event the learned Court of Sessions or

// 2 // Addl. Sessions Judge, as the case may be, shall take up the matter as expeditiously as possible by disposing of the bail application of the petitioner on the same day itself, taking into account the aforesaid decision of the learned trial court in parity.

4. The ABLAPL is disposed of accordingly.
