2. Heard Mr. G. Sinha, learned counsel for the petitioner and Mr. Balabantaray, learned A.G.A

The petitioner has filed the present Writ Petition with the following prayer :- "To direct the respondent No.3 to consider the case of the applicant for appointment against a regular post of Pharmacists in light of the resolution at Annexure-5 Or in the alternative direct the respondent No.3 to consider the case of the applicant for the post of Pharmacist pursuant to the advertisement dated 12.8.2015(Annexure-8)"

It is submitted that pursuant to the order of appointment issued in favour of the petitioner under Annexure-1 on 9.12.2004, the petitioner is continuing in the post of Senior Treatment Supervisor on contractual basis till date. It is also submitted that claim of the petitioner for his absorption in the regular establishment is also covered by the resolution issued by the Govt. in its resolution dated 13.5.2013 under Annexure-5. It is also submitted that the petitioner basing on Annexure-5 though
// 2 // has approached the opp. parties time again, but his case has not been considered. It is also submitted that similarly situated persons engaged on contractual basis have been regularized vide Annexure-8.

In view of such stand taken by the learned counsel, this Court disposes of the Writ Petition with a direction to Opp. Party No.3 to consider the claim of the petitioner for his absorption in the regular establishment, taking into account the resolution issued under Annexure-5 and the order passed under Annexure-8 within a period of three months from the date of receipt of this order. However, it is observed that this Court has not expressed any opinion on the merits of the case.
