This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

In this writ petition, the petitioner Priyanka Priyadarshini Mohanty has challenged the selection of opposite party no.7 Sasmita Pattanaik as Anganwadi

// 2 // Worker of Ramachandi Anganwadi Centre under I.C.D.S. Project, Khordha dated 17.10.2022 under Annexure-3 and the order of her engagement dated 19.10.2022 issued by the opposite party no.6 C.D.P.O., Khordha under Annexure-5.

Learned counsel for the petitioner submitted that even though the petitioner has secured more marks in H.S.C. Examination than the opposite party no.7, which would be evident from the final result sheets of the selection of Anganwadi Worker as per Annexure-3 but the opposite party no.7 has been selected taking into account that she was working as Anganwadi Helper since 01.03.2013 and further taking into account the guidelines for the Anganwadi Workers issued by the Government of Odisha, Women and Children Development Department dated 02.05.2007 which is illegal.

Mr.

Das, learned Additional Government Advocate for the State, on the other hand, submitted that the guidelines provides that A.D.M. is the appellate authority for hearing complaints regarding selection of Anganwadi Workers for tribal and rural projects and urban projects.

In view of such submission made by the learned counsel for the State, learned counsel for the petitioner seeks permission to withdraw this writ petition in order to approach the Appellate Authority.

// 3 // Accordingly, the writ petition is disposed of giving liberty to the petitioner to approach the Appellate Authority.
