This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with S.T. Case No.27/219 of 2018 arising out of Fategarh P.S. Case No.142 of 2018 pending in the Court of learned Additional Sessions Judge, Nayagarh for alleged commission of offences punishable under sections 302/341/294/323/324/325/326/354-B/454/ 380/307/506/34 of the Indian Penal Code.

The petitioner moved an application for bail before

// 2 // the Court of learned Additional Sessions Judge, Nayagarh which was rejected on 21.09.2022.

Perused the status report dated 09.12.2022 submitted by the learned trial Court in BLAPL No.10691 of 2022.

Learned counsel for the petitioner submitted that the petitioner has flouted the terms and conditions of the interim bail order and has not surrendered on due date. In view of such submission, I am not inclined to release the petitioner on bail.

Accordingly, the BLAPL stands dismissed.

Urgent certified copy of this order be granted on proper application.
