Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.1146 of 2021, pending before the learned S.D.J.M., Athmallik, arising out of Handapa P.S. Case No.312 of 2021, for alleged commission of offences under Sections 457/380 of IPC. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Athmallik, by order dated 21.10.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the petitioner is in custody since 24.09.2022 and charge-sheet has been filed on 26.10.2022 and release of the co-accused by order dated 24.02.2022 & order dated 03.03.2022 in BLAPL Nos.11032 & 11227 of 2021 respectively. Hence, the petitioner seeks release.

Learned counsel for the State opposes the prayer for bail on account the criminal proclivity of the petitioner. 6.

Taking into account the nature of allegations, release of the co-accused and the basis of implication, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Keeping in view the criminal proclivity of the petitioner, it is directed that the petitioner shall appear before the jurisdictional police station once every week till conclusion of trial. 8.

Accordingly, the BLAPL stands disposed of.
