The Petitioner challenged the in action of the Opposite Party Nos.2 & 3 in not considering the representation made by him on 22nd November, 2014, for regularization of his service as Laboratory Technician under RNTCP.

Vide order dated 19th February, 2016, the learned Odisha Administrative Tribunal while issuing notice, as an interim measure observed that pendency of the Original Application would not be a bar for consideration of the claim of the application for regularization.

On earlier occasion, when the matter was listed, learned counsel for the Petitioner assured that up-to-date instruction in this matter would be placed on record.

None appeared for the Petitioner at the time of call.

Since this matter has been pending since 2016, it is not felt proper to keep the matter pending any further. By efflux of time, it seems the matter has been rendered infructuous and therefore, the petitioner lost interest to pursue the matter. 6.

In view of such submission, the writ petition stands dismissed for non-prosecution.
