This application has been filed by the Petitioner seeking modification of the Order dated 24.08.2022.

Considering the grounds taken in the application itself and after hearing the learned Counsel appearing for the parties, the Order dated 24.08.2022 is hereby recalled and fresh order is passed today in CONTC (CPC) No. 35 of 2014 in separate sheet. 4.

I.A. stands disposed of.

Mr. S. Jena, learned Standing Counsel for School and Mass Education Department contended that vide order dated 04.12.2021 this Court had given liberty to the petitioner to move after disposal of W.P.(C) No. 2553 of 2016. In the meantime, W.P.(C) No. 2553 of 2016, preferred by the State-authorities has already been dismissed on 05.08.2022 by the order of the Division Bench. 3.

In view of the above, let the order of the Tribunal passed in O.A. No. 3877 (C) of 2011 be complied with within a period of three months from today.
