The Original Application No.46 of 2016 (C) was filed before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No.46 of 2016. 3.

Mr. Abhinash Swain, learned counsel on behalf of Mr. Abhiram Swain, learned counsel for the Petitioner submits that the relief prayed for in the petition has already been meted out and no cause of action survives. Hence, he submits that the Petitioner does not want to press this writ petition.

Mr. Jena, learned Standing Counsel for the School & Mass Education submits that the matter relates to subsistence allowance during the suspension period and he does not have serious objection to the submission of learned counsel for the Petitioner. 5.
