Heard learned counsel for the Parties.

It is alleged that even after supply is made pursuant to the order placed by the Block Development Officer, Simulia on behalf of the Panchayat Samiti, Simulia and a bill is accordingly submitted, there is no consideration on releasing of bill amount. Petitioner even thereto made a representation vide Annexure-3, the same has not been attended as of now.

Keeping in view the decision is required at the end of the Block Development Officer- Opposite Party No.2, this Court finds, the representation becomes premature at this stage. In disposal of the Writ Petition, this Court directs Opposite Party No.2 in the event pendency of any such claim, order as appropriate be taken as earliest as possible preferably within a period of one month from the date of communication of this order by the Petitioner.
