Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 04.09.2021 in connection with Singla P.S. Case No.165 of 2021 corresponding to C.T. Case No.575 of 2021 pending in the Court of learned J.M.F.C., Basta for the alleged commission of offence under Sections 376/120B/303/379/506 of IPC. 4.

It is alleged that the petitioner, who is the village headman falsely projected that the victim and her husband have been divorced and thereafter taking advantage of such fact, he is said to have committed sexual intercourse forcibly with the informant more than once.

Considering the submissions, materials on record, the period of detention in custody and the fact that charge sheet has already been submitted in the case, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and

proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
