2. 1. None appears for the petitioner when the matter is called.
2. When the matter was last taken up on 07.07.2022, none had appeared for the petitioner and to grant another opportunity, the matter was adjourned after considering the same in some detail and the submissions of the learned Standing Counsel :
"2. The writ petition has been registered before this Court on 21.12.2021, after the Original Application was transferred from the learned State Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.
3. On perusal of the available order-sheets of the learned Tribunal, it is indicated that notices were issued by the learned Tribunal on 18.08.2015 and the matter was never taken up/pursed thereafter.
4. The Original Application was filed in the year 2015 by the applicant-petitioner before the learned Tribunal, who was retired as Assistant Teacher for fixation of his pay with effect from 01.01.2006, payment of arrears from 01.01.2006 to 31.03.2007.
5. Learned Standing Counsel for the School and Mass Education Department referring to the averments made in the writ petition submits that the petitioner had retired on 31.03.2007, approached the learned Tribunal in the year 2015, after eight years for fixation
// 2 // of a pay, after nine years of the cause of action, i.e., on 01.01.2006.
6. Since no one is appearing for the petitioner to grant another opportunity to the petitioner, list on 10.08.2022."
3. Learned Standing Counsel reiterates his submissions as noted in the order dated 07.07.2022 indicated above.
4. Having heard learned Standing Counsel, the writ petition is disposed of granting liberty to the petitioner to revive the same within sixty days for any surviving cause of action. ( M.S.Sahoo) Judge Gs
