Learned counsel for the petitioner undertakes to remove the defect within three days.

The petitioner has filed this writ petition seeking direction to the opposite parties to extend MACP benefit on completion of 30 years as on 01.07.2018 taking into consideration the date of entry as 01.07.1988 according to ORSP Rules, 2017 and accordingly revise the pay and disburse the arrear salary, taking into consideration the order passed in the case of Ashok Kumar Mohapatra v. State of Odisha.

In course of hearing, learned counsel for the petitioner states that highlighting the grievance, the petitioner has made representation to the opposite party no.2 vide Annexure-9 and direction may be given to consider and dispose of the same, taking into consideration Annexure-8, within a stipulated time, to which learned Standing Counsel for School & Mass Education Deptt. has no objection. 5.

As agreed to by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.2 to take a decision on the representation filed by the petitioner vide Annexure-9, taking into consideration Annexure-8 and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioner. 6.

Issue urgent certified copy as per rules.
