This matter is taken up through virtual/physical mode. 2.

The Original Application No.107 (C) of 2016 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAPC) No.107 of 2016.

The Petitioner has come up before this Court with a grievance that though the Petitioner was put under suspension, no subsistence allowance has been extended to him. 4.

At the time of hearing today, it is submitted by learned counsel for the Petitioner that no up-to-date instruction could be obtained from his client.

Mr. Nilambar Jena, learned Standing Counsel for the School & Mass Education also submitted that he has no up-to-date instruction in this matter.

It appears that the matter is lying before this Court since 2016 and keeping the matter pending any further, will not serve any fruitful purpose.

The writ petition, therefore, stands dismissed reserving liberty to the Petitioner to revive this petition within a period of ninety days from today, if cause of action still subsists. (M.S. Raman) Judge Jyostna
