2. Heard learned counsel for the parties.

3. The present Writ Petition has been filed with the following prayer:

"(a) to declare Rule 7 (d) of the Odisha Horticulture Service (Method of Recruitment and Conditions of Service) Rules, 2014, which provides that in order to be eligible for direct recruitment a candidate must possesses a Bachelor of Science Degree in Horticulture/Agriculture from any of the recognized Universities or Institutions as unconstitutional;

And consequentially be pleased to hold that the candidates possessing the B.Sc. (AG) qualification are not eligible for recruitment to the post of Asst. Horticulture Officer;

And consequentially be pleased to quash the advertisement no.02 of 2015-16 (Annexure6) so far as it relates to allowing the candidates having B.Sc. (Ag) to compete for the post of Asst. Horticulture Officer;

And further be pleased to direct the respondent no.1 to consider amendment of the recruitment rules, more particularly Rules 7 (d) of Odisha Horticulture Service (Method of

// 2 // Recruitment and Conditions of Service), 201 by confining the Direct Recruitment only to the candidates possessing the B.Sc. (Horticulture); (b) any other order/orders or direction/directions be issued so as to give complete relief to the applicants."

Considering the nature of prayer made in the Writ Petition, the Petitioner is permitted to make a fresh representation before Opp. party No.2 within a period of three weeks days from today.

It is observed that if such a representation is filed by the Petitioner ventilating his grievances, the same shall be considered by Opp. party No.2 in accordance with law within a period of three months from the date of receipt of such representation. The order so passed by Opp. Party No.2 be communicated to the Petitioner also.

With the aforesaid observation and direction, the Writ Petition is disposed of.
