01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- " In view of the facts mention in paragraph -6 above, the applicant prays for the following relief(s).

Under the above circumstances, it is therefore, humbly prayed that this Hon'ble Tribunal be graciously pleased to direct the opposite parties to extend the benefit of promotion to the petitioner to the Level-IV post with effect from the date the junior of the petitioner have been given such benefit and opposite parties be pleased to extend the benefit of RACP as per the scheme prepared by the State Government without any further delay.

And the Hon'ble Tribunal be pleased to direct the opposite parties to calculate the arrear entitlement of the petitioner and to release the same within a time frame."

Considering the facts that no counter affidavit has been filed, liberty is granted to the Petitioner to make a fresh representation ventilating his grievance as made in the writ Petition before the Opp. Party No.2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence, if on such consideration, it is found that the Petitioner is entitled to get any financial benefit, the same is also be disbursed within a further period of three months.

It is observed that if such a representation is filed within the aforesaid period, the Opp. Party No.2 shall do well to take a lawful decision within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.2 be also communicated to the Petitioner.

With the aforesaid observation and directions, the Writ Petition is disposed of.
