Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in G.R. Case No.602 of 2022, pending on the file of the learned J.M.F.C., Jatni arising out of Valley P.S. Case No.188 of 2022, for commission of alleged offences under Sections 341/365/323/386/506/34 of IPC. 3.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned 4th Additional Sessions Judge, BBSR, by order dated 27.10.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioners are in custody since 24.09.2022 and considering the nature of allegations qua the petitioners and as the investigation has progressed substantially, they may be released on bail.

Learned counsel for the State opposes the prayer for bail during the currency of investigation.

Taking into account the nature of allegations and submission of the learned counsel for the petitioners that they have no criminal antecedent, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin.

While releasing the petitioner on bail, learned Court below shall verify assertion regarding the criminal antecedent of similar nature. If the petitioner has any such criminal antecedent, this order shall stand recalled.

Accordingly, the BLAPL stands disposed of.
