This matter is taken up through virtual/physical mode. 2.

The Original Application No. 1117 of 2015 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 1117 of 2015. 3.

The Petitioner has challenged the clarification dated 7th July, 2012 issued by Government of Odisha in Department of Water Resources bearing No. FE-IV-W/C-14/12/8684/WR, whereby it is clarified that worked-charged employee who is retired before completion of 10 years of service would not be qualified for gratuity.

At the time of hearing, Mr. Swapnil Roy, Proxy counsel on behalf of Mr. B.K. Nayak, counsel for the Petitioner submitted that he has no up-to-date instruction in the matter. 5.

Since this matter is pending since 2013, no fruitful purpose would be sub-served if the matter is kept pending any further. Hence, this writ petition is dismissed with liberty to
