IN THE HIGH COURT OF ORISSA AT CUTTACK

BLAPL No. 9680 of 2021 Bhagyadhar Sahoo ....

Petitioner Mr. A.K. Ray, Advocate - Versus - State of Odisha ....

Opposite Party Mr. P.K. Maharaj, Addl. Standing Counsel

CORAM:

JUSTICE SASHIKANTA MISHRA

ORDER

19.04.2022 1.

This matter is taken up through hybrid mode.

Order No.

2.

2.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

3.

It is alleged that the petitioner kept sexual relationship with the victim on the pretext of having a love affair with her since 2017. It is further alleged that the petitioner used to take the victim to different hotels and committed sexual intercourse with her and on one occasion he gave her something to drink, after which she became unconscious, whereupon the petitioner raped her and also videographed such act. The petitioner is also alleged to have threatened the victim several times to make the photographs viral on social media. Some of such photographs were seized during investigation. That apart, the victim has vividly described the role of the petitioner in her statement recorded under Sections 161 and 164 Cr.P.C. statement. All the above facts clearly show a strong prima facie case against the petitioner. 4.

Considering the above, I am not inclined to allow the prayer for bail, which is therefore, rejected. It is open to the petitioner to renew his prayer after examination of the victim during trial. 5.

BLAPL is accordingly rejected.
