01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. R. Mohapatra, learned counsel for the Petitioner and Mr. Karunakar Das, learned Addl. Standing counsel appearing for the State-Opp. Parties.

3. It is submitted that vide Order dtd.12.03.2007 under Annexure-3 the Petitioner was appointed as a Senior Tuberculosis Laboratory Supervisor on contractual. It is also submitted that pursuant to the said order the Petitioner joined in the post and continuing in the said capacity till date.

4. It is further submitted that in spite of such continuance of the Petitioner on contractual basis, the Opp. Parties are not taking any decision on absorption of the Petitioner in terms of the resolution of the Govt. in the Health & Family Welfare Department dtd.13.05.2013 under Annexure-7 as well as resolution of the G.A. Department dtd.16.01.2014 under Annexure-11. It is also submitted

// 2 // that the claim of the Petitioner for his absorption is covered by a decision of this Court rendered in the case of Patitapaban Dutta Das vs. State of Odisha & Ors.

5. In view of such submission made by the learned counsel for the Petitioner, this writ Petition is disposed of with a direction on the O.P. No. 3 to take a lawful decision on the Petitioner's claim for absorption strictly in accordance with the order passed by this Court in the above cited case and the Resolutions issued under Annexure7 & 11. The entire exercise shall be completed within a period of three (3) months from the date of receipt of this order.
