01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. None appears for the Petitioner when the matter is called out.

3. The writ Petition has been filed with following prayer:- "(i) the Hon'ble Tribunal be pleased to declare and direct that non-recommendation of the case of the applicant by the DPC and consequently not giving promotion to him to the next higher rank of Deputy Ranger is illegal and unconstitutional and accordingly the Hon'ble Tribunal be pleased to quash the orders of promotion so far it relates to the juniors to the applicant; and (ii) The Hon'ble Tribunal on such basis be pleased to direct the respondents, more particularly the respondent no. 2, to consider the case of the applicant for promotion and consequently he be given promotion to the next higher rank of Deputy Ranger with all service and financial benefits from the date the same has been extended in favour his immediate junior, private respondent no. 3; and

// 2 // (iii) The Hon'ble Tribunal be pleased to pass such other order/orders as is deemed fit and proper under the facts and circumstances of the case."

4. It is submitted by learned counsel for the State that the Petitioner was given promotion to the post of Deputy Ranger vide office order dtd.30.06.2016 of the Regional Chief Conservator Forest, Berhampur. Since the Petitioner has already got the benefit, nothing remains to be decided in the present writ Petition.
