ORDER(Oral) 11.7.2022 01 1. This matter is taken up through hybrid mode.
2. The writ petition has been registered before this Court on 22.12.2021 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack.
3. On perusal of the available order-sheets of the learned Tribunal it is indicated that notices were issued on 3.9.2015 and prior to issuance of notice, interim order was passed on 26.8.2015. Thereafter on 6.10.2015 notice on contempt was issued for non-compliance of the order dated 26.8.2015 passed by learned Tribunal and C.P. No.256(C) of 2015 was initiated.
4. The O.A. was filed by the petitioner challenging the order of transfer from Bilaput Primary School under Semiliguda Block, in the district of Koraput to Borandi Project Upper Primary School under Kotpad Block by virtue of office order No.5776 dated 18.8.2015.
5. It is submitted by learned counsel for the petitioner that due to long pendency the matter has been rendered infructuous and the petitioner does not want to press the writ petition.
6. Learned Standing Counsel referring to the averments made in the writ petition as well as counter dated 14.12.2015, submits that considering the nature of grievance that is challenge to order of transfer intra district dated 18.8.2015, nothing would survive at present for adjudication.
7. Having heard learned counsel for the parties, the writ petition is disposed of as not pressed.
